摘          要 本研究藉由蒐集並彙整分析主要國家對射頻器材之管制項目及管制方式,輔以低功率電信管制射頻器之電波訊號量測,並舉辦兩場座談會邀集國內電信管制射頻器材製造業、輸入業、專家學者及測試機構或驗證機構舉辦座談會,介紹及討論上述各國鬆綁或修正規定及前揭干擾測試評估結果、簡化測試之建議方案,並蒐集、研析各界之意見及對我國電信管制射頻器材法規之修法建議等,以期精進我國相關管理措施及電信監理效能,加速該等器材進入市場提供服務及提升相關產業發展效益。檢視主要國家低風險性射頻器材之管制趨勢及法規調適情形,近年來雖未見主要國家大幅度鬆綁管制低功率射頻器材,不過因應通訊傳播科技的演進及需求,部分國家採取放寬射頻器材進口及銷售相關規定、調適法規、簡化部分射頻器材的驗證流程等管制趨勢與便民措施作法。

國際主要國家電信射頻器材後市場管理機制方面,依個別國家監理需求及通訊技術趨勢制定必要的管制措施,可分為主動稽查及被動稽查。主動稽查包括隨機抽查市場上販售的射頻器材、以秘密客身分購買射頻器材後再進行測試、射頻器材宣導;被動稽查則如受理申訴及投訴、業者自主申報、民眾情報等。

對於射頻器材的網路通路管制,研析對象國家多數皆以「適用既有規範」為主,除原有的無線電射頻器材相關法規外,再從消費者保護與產品安全的角度,規管射頻器材之網路販售。部分國家則是透過公部門與民間線上購物平臺合作、或平臺業者主動配合政府政策的做法,以公私協力方式,管理線上購物平臺上射頻器材的流通。

主要國家在監管低功率/藍牙醫療設備時,除關注如何達到頻率和諧使用、避免對其他設備造成干擾外,亦越來越關注其器材設備之網際安全及安全漏洞問題。各國對於非通訊設備之低功率/藍牙醫療設備之管制措施,多半沿用既有規範,僅日本總務省因應新的應用需求,針對低功率射頻器材單獨修正新的技術標準,而在現行法規下,多數國家之低功率/藍牙設備須取得型式認證,其中又以澳洲、日本與新加坡管制強度較低;另外加拿大與新加坡則更重視其網路安全問題。

而本研究執行之低風險性電信管制射頻器材與1mW以下無線遙控器實測,發現簡化測試建議方案與工程模式測試結果差異不大,可解決待測物無法提供工程模式之困擾,建議針對國內使用或進口之器材型式認證實測於無法取得工程模式狀況下,可考慮採用簡化測試建議方案。

This study collected and analyzed the control items and control methods of radio frequency equipment in major countries, supplemented by the measurement of radio signal of low power telecommunication regulated radio frequency equipment, and held two symposiums to invite the domestic telecommunication regulated radio frequency equipment manufacturing industry, import Industry, experts and scholars, and testing organizations or certification organizations hold symposiums to introduce and discuss the relaxation or revision of regulations in the above countries, the results of interference test evaluations, and suggestions for simplifying testing, and collect and analyze opinions from all walks of life and my country's telecommunications regulation Suggestions on amendments to regulations on radio frequency equipment, etc., with a view to improving the relevant management measures and the effectiveness of telecommunications supervision in my country, accelerating the entry of these equipment into the market to provide services and improving the development efficiency of related industries.

Review the control trend and regulatory adjustment of low-risk RF devices in major countries. Although no major countries loosen the control of low-power RF equipment in recent years, in response to the evolution and demand of communication and communication technologies, some countries have liberalization the import restriction, regulatory, and convenience measures of RF devices, such as sales regulations, regulatory adjustments, and simplification of the verification process.

In terms of post-market management mechanisms for telecommunications RF devices in major international countries, post-market management mechanisms of telecommunications RF devices are formulated according to the supervision needs of individual countries and communication technology trends, which can be divided into active audits and passive audits. Active audits include random inspections of RF devices sold in the market, and purchased RF devices as a secret customer; passive audits include handling appeals and complaints, self-declaration by the industry, and public intelligence.

Regarding the regulation of online selling of RF devices, the research and analysis found that major countries focus on "applying existing regulations". In addition to the original regulations related to RF devices, also focuses on the perspective of consumer protection and product safety to regulate the online selling of RF devices. Some countries control the RF devices online selling through the public sector and private online shopping platforms, or the platform operators actively cooperate with government policies.

The management of the low-power/Bluetooth medical devices of the major countries focuses on how to achieve harmonious use of frequencies and avoid interference with other devices but also paid more attention to the Internet security and security vulnerabilities of their devices. The control measures of low-power/Bluetooth medical devices that are not communication devices in various countries mostly follow the existing regulations. Only the Ministry of Internal Affairs and Communications Japan has amended new technical standards for low-power RF devices in response to new application requirements. Under the current regulations, Low-power/Bluetooth devices in most countries must obtain Compliance Approval, while Government of Australia, Japan, and Singapore have relatively low regulatory intensity; Government of Canada and Singapore are concerned about network security issues.

For the RF devices for experimental use, major countries such as Government of Japan, South Korea, and Canada allow certification exemption under certain conditions, while RF devices for experimental use in Australia, the United States, and Singapore can only be used after obtaining a license in advance. Compared with the above-mentioned countries, China has stricter controls on RF devices used in experiments, and requires RF devices participating in scientific experiments to still present model approval documents or obtain government-approved license documents.

This research tested 18 low-risk telecommunication control RF devices and 12 wireless remote control devices below 1mW, it was found that the simplified test proposal had little difference from the engineering mode test results. Or if the actual test of imported equipment type certification cannot obtain the engineering model, the simplified test proposal can be considered.
